Today’s Nihon Keizai Shimbun (12 April 2008, p.3) has an article on=
 the possibility that the basic patent for induced pluripotent stem cells i=
n humans may not go to Shinya Yamanaka, not to the University of Wisconsin,=
 but to Bayer.

 

Both Yamanaka and UW announced the success of iPS cells in humans last Nove=
mber and the presumption is that patent applications were filed prior to th=
ese announcements. But now it has come out that Bayer succeeded with human=
 iPS cells earlier in 2007. So if Bayer filed earlier, they may get the ba=
sic patent.

 

Yamanaka appealed to Japanese nationalism to build a national coalition to =
exploit his iPS success. The JPO agreed to build a dedicated database to h=
elp with patent applications. The Ministry of Education, Culture and Scien=
ce put together a network of universities to work on applications. A pooli=
ng arrangement for patent rights is also in the works. The article specula=
tes that a prior application by Bayer could become a major damper to the na=
tional effort.

 

The article speculates that Bayer jumped into the game immediately after Ya=
manaka reported success with murine iPS cells in August 2006.
