QPAT version 6.0

This new version of our increasingly popular patent search service includes a number of new features to increase usability, navigation, user-friendliness, and sharing capability.

Earlier this year PatentExaminer, known in QPAT as Work files, has been fully integrated into QPAT, making it not only a powerful search service but a very useful service to sharing projects.

QPAT v6 offers a number of enhancements to searching, navigating, displaying and exporting search results, including:

• Introduction of a Quick Search page allowing novice patent searchers the ability to perform a basic patent search

• Ability to permanently store, edit, and run a search strategy

• Multi-page index search for assignees and inventors allowing you to quickly see and choose the possible differences in spellings and indexing

• Easy number search allowing you to search and retrieve variations in patent numbers – for example US 5,000,000 or US5000000
 
Navigating

• Links to classification definitions have been expanded to include IPC Reform

• Links to EPOLINE for the EP register

• On-the-fly translations to and from German, Spanish and English

• Significantly enhanced multi-color key word highlighting at both the search and hitlist screens

DesignFinder
Industrial Designs: DesignFinder WO database extended back to 1979

Since August 16th, you can search the complete World database in DesignFinder. It features:

  • An extended back file of complete text records back to 1979.
  • Improved image coverage from 1985 onwards.
  • Improved and more complete legal status record.
  • 1 Record per design and not 1 record per application making it consistent with all other databases.

We hope to soon be add more images prior to 1985.
DesignFinder continue to provide the only comprehensive coverage of Industrial Designs information.

 
 
EPat: The worldwide patent law resource

KAZAKHSTAN – March 2007: Patent Law Amendment

On March 15, 2007, the patent law had been amended in Kazakhstan.
The main change is the abolishment of the “Provisional patent” which is replaced by a new term “Innovation patent”. The “Innovation patent” is dedicated for national applicants.
The duration of an “Innovation patent” is 3 years from the filing application date.
It can be extended, upon request, but not more than 2 years. This kind of patent is granted at the applicant’s risk and responsibility regarding international novelty and inventive step.

Examination points of the innovation patent:

  • Check of the documents according to the filing requirement
  • Check of the unity of invention requirement
  • Check of the establishment of the priority date
  • Check of the local novelty

JAPAN – April 2007: Industrial Design Law Amendment

On April 1st 2007, the Industrial Design law was amended in Japan. As from this date, the expiration of an industrial design had been extended from 15 years to 20 years from registration date.

LIBYA – June 2007: PCT applications

On June 21, 2007, the Libyan Patent Office started accepting PCT applications entering the national phase in Libya. Libya became member of the PCT on September 15, 2005.

YEMEN – July 2007: Patent Law

On July 2, 2007, the Law N. 19 of 1994 came into force in Yemen. This law implemented the patent law provisions. Before this date, there were no examination, publication, granting and payment of annuities by the Yemeni Office.
At the moment there are still no patent proceedings as the implementing Regulations have not been applied yet. Find hereunder the main topics of these regulations:

  • Examination as to form, novelty and industrial applicability
  • Publication in the Official Gazette upon acceptance.
  • Opposition possible within 6 Months from publication date
  • Patent duration is 15 years
  • Renewal fees payable annually from filing date. A 6-month grace period is allowed for late payment
  • Absolute novelty required
  • Patent of addition admissible
  • Priority claim within 1 year from the earliest filed application

Filing application documents required:

  • Power of attorney legalized within 60 days from filing date
  • Extract from Commercial Register legalized within 60 days from filing date
  • Deed of Assignment from the inventor legalized within 60 days from filing date
  • Abstract of invention (English and Arabic) within 60 days from filing date

Certified copy of priority documents, in case of priority claimed, within 90 days from filing date.

OMAN – October 2007: Patent Law Treaty and Budapest Treaty

The Patent Law Treaty (PLT) will enter into force in Oman on October 16, 2007.
The Budapest Treaty will enter into force in Oman on October 16, 2007.

 
EMark: The worldwide trademark law resource  

AUSTRALIA
Trademark Law Amendment - On 27 March 2007, the Australian trademark law was amended. The grace period for a late renewal has been reduced from 12 months to 6 Months.
This change of Grace period only applies for renewals on or after 27 March 2008.

BAHRAIN
Trademark Law Treaty (TLT) - On 18 March 2007, the Trademark Law Treaty entered into force in Bahrain.
Priority Claim - As from 7 June, the IP Office of Bahrain is accepting claiming priority for trademark and industrial design applications.
Although Bahrain is a member of the Paris Convention as of October 29, 1997, claiming priority was not possible until the abovementioned date.

IRAQ
Boycott Declaration - Since 22 July 2007, the Boycott Declaration is no longer required for the filing of trademark applications. This also includes applications pending since 2003.

KAZAKHSTAN
Trademark Law Amendment - On March 15 2007, the trademark law had been amended, the duration of the Use requirement changed from 5 years to 3 years.

SAN MARINO
Madrid Protocol - On 12 September 2007, the Madrid Protocol regarding the international registration of trademarks will enter into force in San Marino.

SINGAPORE
Trademark Law Amendment (Trademark Act 2007) - The trademark Act 2007 amending the trademark law came into force in Singapore on 2 July 2007.
According to this new act, the main changes are as follows:
  • Divisional applications: it is possible to divide a trademark application into two or more applications.
  • Multiple class registration: multi-class applications/registrations are allowed. This allows for one single application in multiple classes of goods and services to lead to one registration. Upon registration, the registration is maintained as one, resulting in the need to renew only once for the renewal to be effective for all the classes of goods and services registered.

SOUTH KOREA
Trademark Law Amendment - On July 1 st 2007, amendments to the trademark law came into force.
As from this date the term for opposition has been extended from 30 days to 2 months.
Holograms are now protected in the protection scope of the trademark system in South Korea.

SYRIA
New Trademark Law - A new trademark law (Syrian Law no.8 of 2007) was issued in Syria on March 12, 2007 and entered into force on April 12, 2007. According to the regulations, the documents required for filing trademark applications are as follows:

1- A power of attorney, notarized. A separate power is required for each application or set of applications. Alternatively, a legalized general power of attorney is accepted and may be used for subsequent filings.
2- Copy of corresponding home/foreign registration certificate (if available), with Arabic translation.
3- Copy of priority document, if priority is claimed, certified.
4- 10 prints of the mark for each application.

According to this new law and starting from April 12, 2007, find hereunder the main changes regarding trademarks:
  • Introduction of a single class system. A separate application should be filed for each class of goods and services. For a multi-class trademark registered under the old law, a renewal application will generate separate renewal certificates according to the number of classes originally registered.
  • Introduction of the use requirement. Non-use of 3 consecutive years makes a trademark vulnerable to cancellation by a third party.
  • Introduction of an opposition procedure. It is possible to oppose to a trademark application within 90 days from the publication date.
  • Trademarks which have successfully passed the opposition period will be published for a second time in the Trademarks Journal for confirmation of registration.
  • The filing date and the registration date are the same.
