BorgWarner Inc. (“BorgWarner”) is a U.S. based worldwide automotive industry components supplier with sales of $5.65 Billion USD and operating manufacturing and technical facilities in 57 locations in 19 countries, including North and South America, Europe, and Asia. The company is primarily known for its advanced powertrain technologies, such as turbochargers, dual-clutch transmission components, engine timing systems, and emissions products.

The Challenge

Background

As one of the largest and most successful automotive parts manufacturers in the world, BorgWarner’s intellectual property strategy is at the heart of their success and could not be compromised. However, during a prolonged automotive downturn, BorgWarner needed to understand all aspects of the patent prosecution life cycle to increase efficiency and to gain the transparency needed to reduce costs. BorgWarner filed and prosecuted applications in multiple countries via a global web of long time agents and patent attorneys. An overburdened in-house team focused on IP strategies simply did not have the resources required to wade through the convoluted and nebulous descriptions of services provided by its international agents.

Solution

BorgWarner retained TIPS to provide a business analysis of its IP costs, including international filing. After reviewing a variety of recommendations offered by TIPS, BorgWarner quickly realized a streamlined approach could simplify its international filing process while providing much needed cost savings. In addition, TIPS has been providing ongoing monthly audits of IP invoices to make sure law firms and international agents are not billing high legal fees relative to the value of the services being provided. TIPS has also been providing a variety of simple to understand cost management reports, along with recommendations on efficiencies and best practices when cost savings opportunities are identified.

Outcome

ITIP’s implementation of TIPS and ProFile services provided BorgWarner with immediate visibility into its patent prosecution spend and, more importantly, a precipitous drop in filing & prosecution costs. ProFile has reliably managed all of BorgWarner’s Paris Convention, PCT International & PCT National Phase filings for over four years now, filing well over a thousand applications and providing BorgWarner with highly specialized resources in a one-stop-shop, user friendly format. USG is a leading innovator for new residential construction, commercial construction, and repair and remodel materials, as well as for products used in certain industrial processes. The Challenge

The global recession brought economic difficulty to most sectors in the global economy, but perhaps nowhere as challenging as the construction industry. Due to the U.S. housing market collapse that started in 2006, USG needed to focus on cost savings, and intellectual property expenses were no exception. Immediate savings needed to be obtained without undermining the company’s worldwide intellectual property protection or harming its relationships with valued domestic law firms and international agents.

Background

Global markets necessitated a global patent filing strategy and USG used a mix of Paris Convention and PCT filing routes into many countries. Relying mostly upon its domestic law firms to manage the company’s international patent prosecution, the expenses for USG’s global patenting program were difficult and time consuming to track and monitor. It also was difficult for the company to continue to streamline its domestic and international patenting procedures and reduce its costs given the staffing limitations imposed by the market downturn.

Solution

After a detailed RFP process with multiple potential e-billing providers, USG awarded its IP cost management business to ITIP, choosing both TIPS and ProFile service offerings. ITIP had the best practices as well as the dedicated and specialized resources that USG needed to implement those best practices. TIPS immediately began the process of analyzing USG’s invoices and existing agent practices, as well as making monthly recommendations on additional cost efficiencies and potential expense reductions. ProFile was implemented for first some and then all of USG’s international patent filings.

Outcome

TIPS’ ongoing analysis of agent invoices verified that ProFile was delivering the savings it demonstrated prior to being awarded the business. Within one year of the initial implementation, USG expanded the ProFile service to handle all of USG’s Paris Convention and PCT filings. ProFile was able to deliver over 50% cost savings vs. USG’s existing agent charges. In addition, TIPS continues to provide ongoing monthly cost management analysis, a wide variety of monthly and custom cost management reports, numerous recommendations and actual solutions for driving efficiency and transparency into USG’s existing patent process. TIPS has also provided ongoing auditing of IP invoices, and constant correspondence with agents on behalf of USG, seeking compliance with policies that were implemented by USG with TIPS’ assistance. Substantial cost savings have been recorded by USG due to TIPS services.
