The Curious Case Of the ‘Black Friday’ Trademark
Everyone has heard about the “Black Friday” shopping extravaganza but did you know it was a trademark? Such marks, whose use has become increasingly widespread, are subject to changes and vulnerable to cancellation, and that is exactly what happened with a German company and the Black Friday mark.
Brandstock Legal's Michael Frank (now part of the Novagraaf Group [1]) discussed this particular case history in an article for World IP Review (WIPR) focused on issues related to the registration of common terms and the role played by Brandstock Legal in front of the Deutsche Patent- und Markenamt (DPMA).
