Terms and Conditions – Questel Competition

By participating in a QUESTEL SAS (hereinafter “Questel”) competition, the participants accept the following competition conditions: 

1. Participation is exclusively reserved for companies in accordance with §14 BGB (German Civil Code). A trader means a natural or legal person or a partnership with legal personality who or which, when concluding a legal transaction, acts in exercise of their trade, business or profession. 

Excluded are employees of Questel, their families, agents or any third party directly associated with the administration of the draw. For the purpose of the present Terms and Conditions, “Questel” means any Affiliate of the Questel group company. The term “Affiliate” shall mean any corporation, association or other entity that directly or indirectly controls, is controlled by or is under common control with the Party in question. As used in this definition of “Affiliate,” the term “control” shall mean having the power to direct or cause the direction of the management and policies of an entity, whether through direct or indirect beneficial ownership of more than 50% of the voting or income interest in such corporation or other business entity. 

2. In order to participate in the competition, participants must have completed the industry benchmarking survey (hereinafter “survey”) in full. 

3. Upon completing the Questel survey, the participants will be entitled to enter the free draw. If the participants would like to take part in the competition, they have to fill in the box provided and enter their company name and email address. 

4. Insofar as personal data must be submitted by participants in the course of participation in the competition, this data is subject to the separate Questel Personal Data Protection Policy, which is set out in the Appendix A and is an integral part of these T&Cs. 

5. The closing date of the free draw is 11.59pm, 30 April 2024 (CET). Entries received after this time will not be valid. 

6. We accept no responsibility for entries not successfully completed due to a technical fault or malfunction, computer hardware or software failure, satellite, network or server failure of any kind. 

7. A winner will be chosen by random draw by 11.59am, 13 May 2024 (CET). 

8. The winner will receive a reMarkable e-Ink tablet, worth £279, and is required to provide Questel with a valid mailing address for the receipt of the price. 

9. The winner will be notified by email and/or telephone within seven (7) days of the prize draw. Participants in competitions must ensure that emails from Questel do not end up in SPAM. Questel does not guarantee that prize notifications will reach the winner. If the winner cannot be contacted or does not claim the prize within seven (7) days of notification, Questel reserves the right to withdraw the prize from the winner and pick a replacement winner. 

10. The participants agree that they may be photographed at a formular prize-giving ceremony and that the photo and/or the name of the company may be published on the pages of Questel as well as on the connected social media channels. 

11. The prize for the winner is non-exchangeable, non-transferable and no alternative in cash is offered. 

12. The decision of Questel regarding any aspect of the free draw is final and binding. No correspondence will be entered into and about it. 

13. The participants are deemed to have accepted and agreed to be bound by these rules upon entry of the competition. Questel reserves the right to refuse entry or refuse to award the prize to anyone in breach of these rules. 

14. Questel reserves the right to hold void, cancel, suspend or amend the free draw survey and competition where it becomes necessary to do so. 

15. Any Legal action is excluded. 

16. In the relationship between Questel and the participant, German law applies exclusively to this competition. The place of jurisdiction is Munich (Germany).
